Bankruptcy of company to avoid brought to court

How can a Montreal construction company specializing in foundation work and building retaining walls and asphalt driveways declare bankruptcy 6 months after the company was sued in Small claims court and reopen a business under a different name. How can the consumer be protected when this is allowed to happen.
